London Borough of Havering – Fail to proceed in direction shown by arrow blue sign

SITUATION

The appellant drove down a one way street the correct way in order to access a car park.

However, the car park was closed. The appellant then turned around and drove back up the same street.


The appellant stated the blue arrow sign had been spray painted over, and supplied images to support this…and yet the Enforcement Authority (EA) still rejected the internal appeals.


WHY WAS IT ALLOWED?

The Adjudicator asked the EA if they had any evidence to show the car park was closed on that day, and to check the maintenance records of the signs. However, the authority did not respond.

The EA also did not show which one of the many blue signs at the location was the subject of the Penalty Charge Notice. The Adjudicator was not satisfied the signage was showing a mandatory direction.

Therefore allowed the appeal.
