The appellant entered a location where it was restricted to motor vehicles, at certain times.
The CCTV footage clearly showed the appellant driving into the restricted location during the restricted time.
The main appeal point used by the appellant was, the the sign was not adequate.
WHY WAS IT ALLOWED?
The Adjudicator reviewed the CCTV footage which did show the alleged contravention.
However, it also showed that the sign with controlled hours was obscured (blocked) from the view of the approaching drivers due to a parked truck.
Therefore the appeal was allowed.
