London Borough of Camden – Parked wholly/partly in a suspended bay or space

SITUATION

The Enforcement Authority (EA) had put notices up in a residential area, which had a large run of parking bays. The purpose of the notices was to suspend the bays temporarily, for whatever reason they felt the need to do so.

However, the appellants vehicle was parked in a bay at the time of the suspension, subsequently received a Penalty Charge Notice (PCN).


When EA’s want to suspend certain areas where parking is permitted, they must provide sufficient warning to motorists of the suspension.

The appellants argument was that there was inadequate warning of the suspension, that did not cover all parking bays sufficiently.


WHY WAS IT ALLOWED?

The adjudicator found that there was insufficient warning of the the suspension of the bays where the appellants vehicles was parked.

Therefore the appeal was allowed.
