London Borough of Brent: Entering and stopping in a box junction

SITUATION

The appellant was caught via a CCTV camera for stopping in a yellow junction box.


At face value it may seem a clear cut contravention.

However, another vehicle approached from the opposite side of the road and moved in front of the appellants vehicle.


WHY WAS IT ALLOWED?

In summary the law is you cannot stop inside a boxed junction if you were cause to stop within the box junction due to stationary vehicles ahead of you.

The CCTV footage showed another vehicle did indeed enter the yellow junction box junction fast from the opposite road which caused the appellants vehicle to stop within the box.

Therefore the contravention did not occur.
