London Borough of Barking and Dagenham – Entering and stopping in a box junction

SITUATION

The Enforcement Authority (EA) believed that the appellant stopped within a yellow junction box.


This is a great example of the law being being followed to the finest detail.


WHY WAS IT ALLOWED?

In summary the law is you cannot stop inside a boxed junction if you were cause to stop within the box junction due to stationary vehicles ahead of you.

The CCTV footage submitted by the EA was not clear. This was due to the a Bus obscuring (blocking) some parts of the footage.

The adjudicator was not satisfied with the evidence that the vehicle stopped within the boxed junction because of stationary vehicles ahead. In essence the reason why the appellant stop couldn’t be determined.

On that basis the appeal was allowed.
